1. Introduction
Greetings from GreenFieldHome ("we," "our," or "us"). Your use of our yacht charter services and website at greenfieldhome.rest (referred to as the "Service"), provided by GreenFieldHome, is subject to these Terms & Conditions ("Terms").
By reserving a charter or using our Service, you consent to comply with these Terms. Should you reject any portion of these terms, accessing the Service will not be permitted.
2. Service Overview
At GreenFieldHome, we offer deluxe yacht charter services, which encompass:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is subject to change and is contingent upon weather conditions. We hold the authority to alter or cease services as necessary.
3. Booking and Reservations
3.1 Booking Process
Booking requirements are as follows:
- A minimum age of 18 years old
- Submission of precise and complete information
- Advance payment of the specified deposit as outlined in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed once payment has been made and we have provided written confirmation. We retain the right to deny service at our discretion.
3.3 Availability
Charters are contingent upon vessel availability and favorable weather conditions. We will strive to accommodate your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All pricing is stated in € and includes taxes where applicable, unless stated otherwise. Pricing is subject to revision without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total charter cost is payable at the time of booking
- Balance: Required 48 hours prior to the departure of the charter
- Incidental charges (where applicable): Payable upon charter completion
4.3 Payment Methods
We can process payments via major credit cards, bank transfers, and certified cheques utilizing secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice prior to departure: A complete refund minus transaction fees
- Between 24-72 hours before departure: 50% refund of the amount paid
- Within 24 hours of departure: No refund will be offered
5.2 Weather Cancellations
For cancellations due to unsafe weather as deemed by our captain, the options are:
- Rescheduling your charter to an alternative date at no additional expense
- Issuing a complete refund when rescheduling is unfeasible
5.3 Mechanical Issues
If mechanical problems occur with the designated vessel, we will attempt to supply an appropriate substitute. Should no replacement be available, a full refund will be given.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Adhere to the instructions of the crew
- Utilize provided safety gear as directed
- Disclose any health conditions impacting their safety
- Restrict themselves to the vessel's designated areas
6.2 Prohibited Items
The following are not allowed on board:
- Glass containers
- Illegal substances
- Firearms or other weapons
- Pets, except if granted prior consent
6.3 Conduct
Passenger behavior should be respectful at all times. Charters can be ended prematurely without a refund if a passenger's actions constitute a safety hazard or interfere with the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is restricted to the charter fee that you have paid. We hold no responsibility for:
- Injuries sustained due to passenger negligence
- Theft or damage to personal belongings
- Indirect, incidental, or punitive damages
- Delays attributable to extreme weather or other factors outside our control
7.2 Insurance Coverage
We uphold comprehensive maritime insurance that includes coverage for our boats and operational activities. Passengers should have their own travel and personal insurance.
7.3 Assumption of Risk
By partaking in our charter services, you accept that there are inherent risks associated with water activities, and you take on the responsibility for your own well-being.
8. Modifications and Itinerary Changes
Itinerary adjustments, route changes, or schedule modifications may be made due to weather or safety concerns, or if there are operational necessities. We will endeavor to provide a similar alternative experience whenever possible.
9. Force Majeure
We shall not be held accountable for any delays, cancellations, or alterations caused by events outside of our control, including but not limited to:
- Severe weather events
- Natural disasters
- Governmental decrees or regulations
- Port closures
- Vehicular malfunctions
10. Privacy and Data Protection
We take the privacy of your personal data seriously, as shown in our Privacy Policy. Your use of our services denotes agreement to the policy's terms concerning information collection and usage.
11. Intellectual Property
All content on our website, including, but not limited to text, graphics, logos, and illustrations, falls under copyright and trademark protection. Any use, distribution, or creation of derivative works must be sanctioned by us formally in writing.
12. Governing Law
The laws of Montenegro govern these Terms, with any disputes resolved within the jurisdiction of the courts located in Tivat, Montenegro.
13. Changes to Terms
We may change these Terms at our discretion. Such amendments will be indicated by an updated date of revision on our website. Your continued usage of our services after changes implies acceptance of the revised terms.
